Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Jersey Silkies website, products, and related services. By placing an order or using our site, you agree to these Terms.

If you are using our services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Jersey Silkies offers timed auction listings described as “silent sprinkles.” A silent sprinkle is a standalone listing with its own bid or Buy it now flow — it is not added to the shopping cart and does not require you to purchase any other product, DNA sample kit, or service before you bid.

You must have an account to place a bid or use Buy it now. Anyone may create a free account on our site. All silent sprinkle start and end times are shown in Eastern Standard Time (EST) year-round unless we state otherwise on the listing.

To place a bid, you must complete bid checkout, accept these Terms, and authorize a payment card through Stripe for at least your bid amount. PayPal is not accepted for silent sprinkle bids or auction checkout. By submitting a bid, you agree that your bid is a legally binding offer to purchase the listed item at that price if you are the highest eligible bidder when the auction ends.

If another bidder places a higher eligible bid, the authorization hold on your card for the outbid amount is released. You may place a new bid subject to the same terms. Each bid requires its own card authorization at bid checkout.

When a silent sprinkle ends, the highest eligible bid at or above any stated reserve price wins. If no reserve is listed, the highest bid wins. If no qualifying bids are received, or the reserve is not met, the listing may end unsold.

If you win, we may capture payment from the same card you authorized when bidding. If capture is unsuccessful, you must complete auction checkout and pay the full winning amount within twelve (12) hours of the auction end time (or within twelve (12) hours of Buy it now, if applicable) using an accepted payment method. Gift cards may be applied at auction checkout; discount codes may not.

Buy it now, where offered, ends the auction immediately and creates the same payment obligation on the winning amount and the same twelve (12) hour claim window.

Failure to pay within the claim window may result in cancellation of your order, release or reversal of any authorization, and forfeiture of the item. We may cancel bids or orders, or suspend bidding privileges, in cases of suspected fraud, payment failure, chargebacks, or violation of these Terms.

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel orders, including in cases of suspected fraud, pricing errors, or unavailable inventory.

DNA sexing results are provided for informational purposes related to flock management. Results depend on the quality of submitted samples and proper collection procedures outlined in your kit instructions.

Shipping timelines and costs are shown at checkout. Risk of loss for physical goods passes to you upon delivery to the carrier, except where otherwise required by law.

Unused kits may be eligible for return within the timeframe stated at purchase. Opened or used collection materials may not be returnable for safety and quality reasons.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree not to misuse our services, interfere with site operation, attempt unauthorized access, or use our products in violation of applicable laws or regulations.

Our services are provided “as is” to the fullest extent permitted by law. We disclaim warranties not expressly stated in writing.

To the extent permitted by law, Jersey Silkies will not be liable for indirect, incidental, or consequential damages arising from your use of our website or services.

We may modify these Terms at any time by posting an updated version on this page. Continued use of our services after changes become effective constitutes acceptance of the revised Terms.
